FCC Affirms Fine Against WMJX For Contest Rule Violation

    The FCC has affirmed its $4,000 fine against GREATER MEDIA ‘s GREATER BOSTON RADIO, INC. for a contest rule disclosure violation at AC WMJX (MAGIC 106.7)/BOSTON.

    The station ran a contest involving a car giveaway that turned out to be a two-year lease rather than ownership and required a winner to qualify in a credit check, which was not disclosed on the air.  Promos for the contest also did not directly refer listeners to the station’s website for complete rules.

    GREATER BOSTON asked for the punishment to be admonishment with no fine, but the Commission said that a fine was warranted, noting that the station “essentially broadcast a false announcement of the grand prize rather than a vague one, failed to broadcast anything clarifying what it would award, and instead awarded something different than what it announced … Omitting or obscuring such a fundamental Contest term as the Contest prize undermines the essence of the contest rule, which is designed to ensure that listeners are accurately informed of the material terms of the contest.”

    More Fines

    Also, the FCC has fined PBI, LLC $8,000 for failure to maintain operational EAS equipment or keep records noting why EAS tests were not received at Country KDDD-A and Oldies KDDD-F/DUMAS, TX.

    In addition, the Commission fined MARTIN BROADCASTING, INC. $8,000 for tower lighting violations at its tower in BEAUMONT, TX.  The fine was reduced from $10,000 due to a history of compliance with the rules.  MARTIN owns Urban Inspirational KZZB-A/BEAUMONT.

    And WAGENVOORD ADVERTISING GROUP, INC. has been fined $7,000 for tower enclosure violations at Talk KLRG-A/SHERIDAN, AR.
